TERMS AND CONCITIONS OF VIENNA RIDDLE RALLY

 

  1. General

“Vienna Riddle Rally” is a brand of the event agency Himbeere – Owner: Mario Herbert Stoiber. The general terms and conditions (GTC) of this agency apply, with the following changes and additions.

 

  1. Conclusion of Contract

Vienna Riddle Rally distinguishes between three main categories: Education, Adults, and Business.
The client acknowledges the validity of these GTC by signing an offer/contract, submitting a booking via the online booking form, email or phone, or when booking via the ticket shop.
For bookings in the Education and Adults categories, a binding contract with Vienna Riddle Rally is automatically concluded.
For bookings in the Business category, §2 of the Himbeere agency’s GTC regarding contract conclusion applies.

 

  1. Services and Fees

Our services and prices are listed on our website https://wiener-raetselrallye.at under each product or are communicated via a formal offer.

 

  1. Changes to the Order

Changes or deviations in individual services by Vienna Riddle Rally that become necessary after the conclusion of the contract will be communicated to the client without delay. As long as the agreed content of the contract is not or only insignificantly affected by such changes, the client is not entitled to terminate the contract.

 

  1. Postponement of Dates

Clients may postpone a rally date free of charge up to one week before the event in all categories.
After that, a processing fee of 15% of the total amount will be charged.
Minor time shifts (max. +/- 1 hour) are excluded from this rule.

 

  1. Cancellation and Withdrawal

A) Categories EDUCATION and ADULTS

a) Bookings via booking form, email, or phone:

  • Cancellations due to a pandemic are possible at any time and free of charge.
  • Cancellation up to the 15th day before the rally: free and informal (email or phone).
  • Cancellation from the 15th to the 4th day before the rally: 50% of the total amount will be charged.
  • Cancellation from the 3rd day until the day of the rally: 100% of the total amount will be charged.

b) Bookings via the ticket shop:
No refund is possible. Instead, we issue a voucher for the invoice amount or reschedule the event.

 

B) Category BUSINESS

a) Bookings via booking form, email, or phone:
Cancellations must be submitted in writing. The date of dispatch determines the following cancellation fees:

  • From booking until 5 weeks before the event: 25% of the agreed total amount.
  • Until 2 weeks before the event: 50% of the agreed total amount.
  • Until 3 days before the event: 75% of the agreed total amount.
  • From 3 days before the event or no-show: 100% of the agreed total amount.

b) Bookings via the ticket shop:
No refund is possible. Instead, we issue a voucher for the invoice amount or reschedule the event.

 

  1. Invoicing

A) For bookings via form, email or phone:

  • Education – Analog rallies with paper game sheets and maps:
    Billed based on the number of actual participants.
  • Business / Adults – Analog rallies:
    Billed based on the submitted participant list or guaranteed number (to be sent via email no later than 3 days before the event). If more people take part, actual numbers are used.
  • All categories – Digital tablet rallies:
    Billed based on the number of tablets ordered up to 3 days before the event. If more are needed on the day, actual usage is billed.

B) For bookings via the ticket shop:

  • The booked number is invoiced, even if fewer people or tablets are needed. If more tablets are needed on the day, additional invoicing follows immediately after the rally.

 

  1. Payment

Invoices must be paid without deductions or fees to:

A) For bookings via form, email or phone:

Unless otherwise agreed:

  • 50% of the gross invoice amount is due one month before the event,
  • The remaining 50% is due 3 days before the rally or paid in cash on-site.

B) For ticket shop bookings:

Payment via PayPal, credit card, instant transfer, Giropay and other options. Payment processing is handled by Stripe.

 

  1. Resellers

Resellers who book via form, email or phone receive a 10% commission on list prices.
Invoices are issued retroactively with a 14-day payment term.
If payment is delayed by more than 15 days, the commission is voided and the full list price will be invoiced.
No commission is granted for ticket shop bookings.

 

  1. Validity of Vouchers / Value Vouchers

Until further notice, the following applies:

  • Vouchers are valid for 1 year from the purchase date.
  • Value vouchers are valid for 3 years from the end of the purchase year.

 

  1. Liability Disclaimer for Means of Transport

All rallies are intended to be completed on foot.
Participants with disabilities may use necessary aids (wheelchair, walker, etc.).
The use of unnecessary or rented means of transport (e.g. city bikes, e-scooters, Segways) is strongly discouraged.
Vienna Riddle Rally is not liable for any damages, injuries, or accidents resulting from such usage.

 

  1. Tablet Games

If a tablet rally cannot be conducted due to technical problems outside the control of Vienna Riddle Rally (e.g. network, hardware, or software provider issues), the customer has no right to a refund or compensation.

 

  1. Device Damage (Tablet Rallies)

If a tablet provided by Vienna Riddle Rally is damaged or lost due to participant behavior:

  • First, the client’s liability insurance (e.g. school or company) is addressed.
  • If not successful, the participant’s personal liability insurance is approached.
  • If both fail, a mutually agreed settlement will be sought.

 

  1. Ownership

All content (documents, photos, etc.) in print and digital form remains the property of Vienna Riddle Rally.
Game materials and devices are handed out at the beginning and collected at the end.
Copying, photographing, publishing, or forwarding of game content is a violation of business confidentiality and will be prosecuted.
Unauthorized use, acquisition, or disclosure of trade secrets may result in injunctions, removal, and compensation claims.
